Ethical Challenges Facing Online Mediations

This course explores some of the ethical challenges facing online mediation. Online mediation is an emerging method for conducting mediations, using live real-time video technology to conduct the meeting. This allows mediators to expand their services beyond their local community, serve a wider audience of people, overcome cultural barriers, increase public awareness of mediation, and include the millennial and younger members of our population.

However, there are also some ethical challenges that need to be considered when conducting mediation online. These include:

Confidentiality: Ensuring that the mediation process is confidential can be more difficult when mediation is conducted online.
Impartiality: Mediators need to be even more careful to maintain their impartiality when mediating online, as they may not be able to see the parties' body language or hear their tone of voice.
The use of technology: Mediators need to be familiar with the technology they are using and how to use it effectively. They also need to be aware of the potential for technical problems to disrupt the mediation process.

This course will explore these ethical challenges in more detail. We will also discuss how to mitigate these challenges and ensure that online mediation is conducted in an ethical manner.
